As you probably can guess, we have some house rules.  Please follow them. They’re pretty easy to follow.  Then everyone is happy.  It’s a win - win.

“We” “Us” and “Our”: the company Curtain Call Ltd also referred to as Curtain Call

“Employer” or “Recruiter”: an organisation (or individual acting for an organisation) using the platform to find freelancers for collaborative work projects

“Freelancer”: an individual member working within the entertainment and events-based industries, with recognised job roles and skills, using the platform to find work and promote their own professional services

“Marketplace”: The part of the Site that allows individuals and organisations to buy and sell classes, courses, services or events.

“Member”:  An individual or organisation who has signed up to create an account and membership on the Site.

“Original Content”: Any audio, video, photographic, written or originally devised content and material in any format created by Curtain Call and its employees.

“Profile” “Job Profile” and “Profile Page”: the page on the Site which your employment history, biography and other information allowed by You is displayed

“Registration Information”: information that is requested during the membership registration process, such as name and email address

“Seller” is any Member or User that is offering a product or service on Curtain Call’s Marketplace

“Services” is any service that Curtain Call provides its Members and Visitors to the Site (for example, Search and Match / Marketplace / Availability, etc.)

“User”: Any person or entity that is accessing or using the functions on the “Site / Platform”.

“You” or “Your”: any User or Member reading these Terms and Conditions.

ANTI-DISCRIMINATORY POLICY

Here at Curtain Call we take the safety, security and well being of our members and users very seriously.  We want anyone and everyone who visits our platform to feel safe.

Therefore, we ask our users to consider the intention and the impact of the words and actions used on the platform.

This section of our terms and conditions sets out the types of behaviour that Curtain Call prohibits.  This ensures that users and members have a great experience whilst visiting our site.

Users may not use Curtain Call and its services to discriminate in any way against any persons based on any personal attributes or characteristics that may or not be protected under applicable law.

Curtain Call will also never tolerate hate speech which we define as including, but not limited to offensive, demeaning, vulgar or violent. If you believe you have been targeted as a recipient of hate speech, please inform us immediately at help@curtaincallonline.com

Curtain Call reserves the right to terminate membership or access privileges to anyone found breaking this policy.

 

SITE ACCESS

Visitors to the Site (“Users”) can access some information without a registration. Members should be aware that any information you choose to make visible on their Profile can be seen by Users of the site.

Registered Users (“Members”) can access the website and its services, content and functions.  Some services offered by Us require an additional subscription and you may be required to make a payment. This will be clearly indicated and you will be able to decide before confirming payment.

Each User name permits one person to access the password-protected portion of the Site. You agree that you will not share your user name and password with any third party. 

By becoming a member of Curtain Call you agree to being signed up to our newsletters. If you would like to opt out, either unsubscribe on the newsletters or contact us on info@curtaincallonline.com.

As a Member of Curtain Call you will receive service emails, which are required as part of the service that we provide, for which you have joined the Site.

Membership is contingent on acceptance of these Terms and Conditions and the Privacy Notice.

Such Users are not permitted to register or subscribe to the Site unless the parent, guardian or agent of a such User registers on behalf of them. MARKETPLACE

Curtain Call’s offers a service to its Members and Users to connect through its Marketplace.  Members and Users can offer each other goods and services in exchange for payment, unless otherwise stated as a free offer on the Marketplace.


Curtain Call’s Marketplace consists of third party sellers who are responsible for their own offerings regardless of the form that offering takes. (i.e. digital, physical or remote).


Curtain Call neither manufactures nor holds any stock of any kind that is offered through the Marketplace.

MESSAGING


Members of Curtain Call may send direct messages to each other using the Messaging Service within the Platform. By using the Messaging Service, you agree to the Terms and Conditions laid out in this document.  In addition, you agree to not send messages that are in any way considered:

  1. Discriminatory
  2. Abusive, derogatory, demeaning, harassing, 
  3. Vulgar, insensitive or obscene.
  4. Advertising or marketing.


If you receive any message that you deem to be offensive or can be classified as pertaining to the descriptions laid out above, please immediately get in touch with us at help@curtaincallonline.com.  


Curtain Call has a ZERO TOLERANCE POLICY for prohibited language or messages of the type listed above. If a Member or User is deemed to have broken this policy, Curtain Call reserves the right to immediately suspend or terminate a Member’s or User’s account.


Intellectual Copyright and Use of Curtain Call Content and User Generated Content


CREDIT RECLASSIFYING

Curtain Call retains the right to reclassify credits without the user’s consent if it is deemed that a credit has been wrongly (either inadvertently or advertently) requested.  If Curtain Call believes this is the case, you will receive an email explaining that your credit request has been modified.


CONTENT ERRORS (MEMBER)

If Curtain Call or one of their affiliates / partners observes information you have provided that Curtain Call does not deem to be correct, Curtain Call will contact you with the email connected to your membership.  If you believe that the credit has been changed erroneously, contact info@curtaincallonline.com

CONTENT ERRORS (CURTAIN CALL) 

If you spot anything on the Curtain Call website deemed incorrect, please inform a  representative of Curtain Call by emailing info@curtaincallonline.com.

 

CONTENT REPORTING

If there is an image or content on the Site that you are not happy with, please report this by emailing us at info@curtaincallonline.com

Curtain Call takes copyright infringement extremely seriously. If you have reason to believe that a copyright infringement has taken place, regardless if said content has been created by Curtain Call or a third party, please contact info@curtaincallonline.com

PRIVACY

Curtain Call is committed to protecting the privacy of the site’s Users and Members. Please review our Privacy Notice which gives full transparency on our data protection policy and GDPR compliance. 

By using our services, you agree that we can process your information as set out in our Privacy Notice. 

Each User or Member using Curtain Call is responsible for the personal information they process when using our services or providing services on the Curtain Call Marketplace.

Curtain Call will not be held responsible for personal data disclosed by a Buyer or a Seller or any other user on Curtain Call.

MEMBERSHIP CANCELLATION

In the event of the Member wanting to cancel their account, they may do so at any point by either choosing ‘Cancel my account’ in their Account settings and following the instructions or emailing info@curtaincallonline.com.

The Member’s subscription would then terminate at their next given renewal date. 

TRANSACTION CURRENCIES

Transaction currency on curtaincallonline.com is made in Pound Sterling (GBP). All transactions made will be made in Pound Sterling (GBP). 

If Pound Sterling (GBP) is not your local currency, Stripe will convert this at the payment screen phase of your transaction.

PROMO CODES

From time to time, Curtain Call may run promotional codes / offers. All promotional codes / offers are subject to availability. Curtain Call Ltd reserves the right to change the promotional codes / offers without advanced notice.


INDEMNIFICATION

You agree to indemnify, defend and hold Curtain Call, its affiliates, subsidiaries, directors, officers and employees (collectively “Indemnified Person(s)“) harmless from and against any and all third party claims and any related liability, loss, and expense (including damage awards, settlement amounts, and reasonable legal fees), brought against any Indemnified Person(s), arising out of, related to or which may arise from Your breach of the terms and conditions of this Agreement or in relation to the Marketplace or any business, activity or transactions carried out or performed on the Marketplace.


In no event shall Curtain Call be liable for any consequential, special, indirect, exemplary, or punitive damages incurred by users or members using the platform (including loss of income, profits or decrease of turnover).


LEGAL JURISDICTION

This Agreement shall be governed by the laws of England.
